    This is another fiasco that nobody has thought through. Years ago, if you wanted to get rid of a pesky spouse or a nasty neighbor, you went down to the police department and swore they were nuts, the cops came to the house and dragged them out, and they were locked up indefinitely. No trials, no hearings, no recourse, just the word of somebody that had an ulterior motive. They may have stayed there for months or for years. It went on for a hundred years or more. Then they decided that there were too many people in the nut-house, some didn’t need to be there, and their rights were being violated. So they turned all of them loose. And now you can’t get anybody committed no matter how crazy or dangerous they are. And the real crazies are now out there with access to weapons. So with this, they’ll go in, just like they did at the confiscation scene where they broke down an innocent man’s door under cover of darkness and with no notice, simply on the word of someone who may or may not have been reliable, and expected him not to be alarmed. That went really well, didn’t it? How many of you have a crazy neighbor or relative who would file a false complaint on you? How many of you would not defend your home and family if somebody broke down your door? This is a ridiculous, dangerous, and communist piece of legislation, and it needs to be stopped. It’s only going to make things worse.

    I am against this bill. Who makes the judgement that a person is a threat or a danger? There must be evidence that the person is a true danger, i.e. medical testing and documentation. Only a psychiatrist can make that determination. Otherwise we will have someone claiming someone else is a danger because they are having problems with or simply don’t like that person. We have enough “big brother” invasions in our lives now,

        Michael they keep gettingvoted in because of northern VA ! Closer proximity to DC is my guess why they vote that way. Looks like really high population centers, big cities, etc vote Democrat for some reason. My theory is in cities like that people depend more on govt for housing, transportation, policing, security, , etc. so they are used to govt providing for them, like Democrats want them to feel like. Simply like sheep, with govt being the shepherd leading them to slaughter. There aren’t as many gun people in big cities either like rural VA, they have police response times in less than 5 minutes, where it’s 45+minutes for my area. I’m not anti police, I just can’t depend on police to protect me, and big cities don’t have hunters and farmers that use guns to protect livestock and crops like rural areas either. Sad. Very sad. Democrats have turned Socialist right before our eyes, and yet people are blind to it.

    Contact your General Assmbley representatives to vote against this legislation. It will only cost millions in the courts because of its unconstitutional grounds. Law enforcement officials are going to make a decision on following unconstitutional policies in the meantime , I pray they make the right one or do they kill someone that has done absolutely nothing illegal on a whim.

    They already do this exact process when the State takes people’s kids. I don’t agree with either process under the “color of law.” Both processes should be stopped/prevented immediately. They are both unconstitutional.

    The ‘government’ (both state and federal) thoroughly enjoys making ‘laws’ and their enforcers (police) thoroughly enjoy enforcing them. They are, however, constrained by the courts (especially our Supreme Court) in their application of their “laws” . While government doesn’t like to admit there are limits on their authority to create “laws” and their enforcers claim that they enjoy legal immunity as long as they’re “just following orders” (Adolf Eichmann claimed the same excuse before he was hung in Israel) our Supreme Court warned them quite clearly in Schick v. United States, (1904) 195 US 65, 49 L.Ed. 99, 24 S.Ct. 826 that: “If there is any conflict between the provisions of the Constitution {enumerated powers to make law} and the provisions of the Amendments {Bill of Rights}. Amendments MUST control.”

    Government ignores this directive from our highest court and would have you believe they have lawful power and authority to regulate, license and, as it sees fit, – deprive by legislation – the Right of the people to “keep and bear arms” in spite of the fact the our Supreme Court reminded them in Miranda v. Arizona:  “Where rights, secured by the Constitution are involved, there can be no rule making or legislation which would abrogate them.” Thus, the legislature (state or federal) can not simply ‘pass a law’ that strips the Rights from Citizens and have it be lawful or Constitutional. Read and think very carefully about their directive: ”there can be no rule making or legislation which would abrogate them.”  Decisions of the Supreme Court and Rights protected by our Constitution can only be overturned by constitutional amendment.

    Indeed, the only way government can “infringe” upon the Right of the People to keep and bear arms is to Amend our Constitution using Article V of our Constitution to acquire the ‘authority’ to “infringe” before they ‘legislate’ any limitations, restrictions, rules or regulations. Until they have the lawful authority as a result of a Constitutional Amendment, our Supreme Court has said (Norton v Shelby) that: “An unconstitutional act is not law; it confers no right; it imposes no duties; affords no protection; it creates no office; it is in legal contemplation, as inoperative as though it had never been passed” What that means is merely passing ‘laws’ doesn’t make them ‘lawful’ or binding on the public.  A ‘law’ needs to be Constitutional to be “lawful” and effective.

    The court has said quite clearly (in Miller v. U.S.) that: “The claim and exercise of a constitutional right cannot thus be converted into a crime.” They’ve said quite clearly (in Shuttlesworth v. City of Birmingham) that:  “If the State converts a right (liberty) into a privilege, the citizen can ignore the license and fee and engage in the right (liberty) with impunity.” and gone on (in Sherer v. Cullen) that: “There can be no sanction or penalty imposed upon one because of the exercise of constitutional rights.“  

    Ask yourself, if your legislature passed a law making it a felony for anyone in Moscow to drink Vodka would such a law have any real “lawful” effect? The legislature has no authority/power to write laws effecting Moscow or prohibiting their residents from having a drink. Likewise, the legislative branches have no authority to rewrite or Amend our Constitution using mere legislation. As the court said in Miranda ~ “Where rights, secured by the Constitution are involved, there can be no rule making or legislation which would abrogate them.” Without an Article V amendment, ratified/adopted by three fourths of the States, giving the legislatures the power/authority to “infringe” on the Right that the 2nd Amendment precluded the government the authority to “infringe” upon, any ‘gun law’ they pass “imposes no duties; affords no protection; it creates no office; it is in legal contemplation, as inoperative as though it had never been passed”.

    Most of the democratic party such as members of the NLRB, EEOC, NSA, FBI, and others communities as such have been using black magick and other forms of abuse trying to spell up gun violence to take our weapons. They think if theres no weapons, then there’s no way they will pay a consequence for using satanic rituals on our children and adults. The number 16 related to pagans is also a terminology related to the arrest of many pagan witches who molested a series of children in United States History and court documented. They rather molest children and take our guns so us as patriots of this nation can not defend our children and adults. SB16 really, and another thing the dangerous thing about this is the factual information behind it. They will still have weapons because they wont obey the law. As a member of a world-wide fraternity and member of many charitable organizations I have come to a conclusion that as our older generations pass away the younger generation will forget about the revolutionary war where we fought and many of our ancestors died freeing our citizens from a form of slavery. Those same witches to this day come to our country waving their hands with the well known pitch forks beside our PRESIDENT expecting us to give in once again to their countries way of life. A fool would lay the constitution down and our freedoms down for a country known to enslave their own citizens with such puppeteering methods. Its a shame and hopefully we can fight until they lose once again. Why must we fight a revolutionary war once again? I stand against being a puppet while they try to use story line after story line that they sent through technological advances. Many of these men have lied and ran my name down across this nation so they could look good for a mission that should of been aborted a long time ago.
